1. Acceptance of Terms

By accessing and using vidshero ("Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by the above, please do not use this service.

vidshero is an AI-powered short-form video generation platform that creates scripts, voiceovers, images, and fully-edited videos from a single topic prompt using cutting-edge AI technology.

2. Description of Service

vidshero provides the following services:

• AI-powered short video generation (Shorts, Reels, TikTok) from topic prompts
• Long-form narrated video generation with Pexels stock footage
• Character-consistent video generation using your own photo
• AI voiceover generation with 130+ multilingual voices
• AI image generation (Flux Schnell) per video scene
• Animated clip generation (image-to-video, 5 seconds per clip)
• Built-in video editor with timeline, captions, music, and effects
• Video export in MP4 format with watermark-free options

3. Pricing and Billing

Credit-Based System

VidsHero operates on a credit-based system. Credits are consumed when generating videos, images, voiceovers, and animated clips. Credit costs vary by action — for example, each AI image generation costs 1 credit, each animated clip costs 6 credits, and full short video generation typically costs 13–50 credits depending on length and features.

Credit Packs

You can purchase credit packs at any time. All payments are processed securely. Prices are subject to change with 30 days notice.

• Credits do not expire and remain in your account until used
• No recurring subscriptions unless you choose a subscription plan
• Pay only when you need more credits

3a. Abandoned Cart Recovery

When you enter your email address and begin the checkout process for any vidshero product, you acknowledge and agree that:

• If you do not complete your purchase, vidshero may send you one or more automated recovery emails via our payment processor (Creem) to invite you to return and complete your order
• Recovery emails are sent after approximately 24 hours of checkout inactivity
• You may opt out of recovery emails at any time using the unsubscribe link included in each email, or by contacting us at contact@vidshero.com
• Transactions completed through a recovery email link are subject to a 5% fee charged by Creem — this does not affect the price you pay; it applies to recovered revenue on our side

4. User Responsibilities

As a user of VidsHero, you agree to:

• Provide accurate information when creating your account
• Use the service for lawful purposes only
• Not attempt to reverse engineer or copy our AI pipeline
• Not use the service to generate harmful, illegal, or copyrighted content
• Respect rate limits and fair-use guidelines
• Only upload images and content you have the right to use
• Not impersonate others or create deepfakes without consent
• Comply with all applicable laws, platform guidelines (YouTube, TikTok, Instagram), and regulations

5. Content and Intellectual Property

Generated Content

You retain full ownership rights to all videos, images, and voiceovers generated through VidsHero. We do not claim any ownership over the content created using our service.

Content Responsibility

While we strive to generate high-quality content, you are solely responsible for:

• Reviewing all generated videos for appropriateness and accuracy before publishing
• Complying with copyright laws (music, footage, imagery)
• Respecting portrait rights and privacy of individuals
• Meeting any disclosure requirements for AI-generated content on publishing platforms

Platform Rights

VidsHero and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws.

6. Privacy and Data Protection

We take your privacy seriously. Our data practices include:

• Uploaded images (e.g. character photos) are stored temporarily or in your account on Cloudflare R2
• Generated videos and images are saved to your account for your convenience
• We use your data only to provide and improve our services
• We do not sell or share your personal information with third parties
• You can request deletion of your data at any time

7. Service Availability and Limitations

While we strive for high availability, VidsHero is provided "as is" and we cannot guarantee:

• Continuous, uninterrupted service availability
• Perfect accuracy or quality of all generated videos or images
• Specific processing times (video generation typically takes 1–5 minutes)
• Compatibility with all publishing platforms or devices
• Specific outcomes from AI generation prompts

We reserve the right to modify, suspend, or discontinue the service with reasonable notice.

8. Prohibited Uses

You may not use VidsHero to:

• Generate content that violates any laws or regulations
• Create misleading, false, or harmful information
• Generate deepfakes or impersonate others without consent
• Create explicit, offensive, or inappropriate content of any kind
• Attempt to abuse or overload our systems
• Share your account credentials with others
• Use the service to compete directly with VidsHero
• Generate content that infringes on others' intellectual property
• Violate anyone's privacy or publicity rights

8a. Acceptable Use Policy — Content Safety

VidsHero is a platform for creating legitimate, creative, and informational video content. The following content is strictly and explicitly prohibited on our platform, regardless of intent, framing, or context:

• Sexually explicit content: Any generation of sexually explicit material, pornography, nudity, or sexual acts — including simulated, animated, or AI-generated depictions.
• NSFW (Not Safe For Work) content: Any content that would be considered inappropriate for general audiences, workplaces, or public platforms.
• Adult content: Content intended for adults only that depicts, suggests, or promotes sexual themes, sexual violence, or non-consensual acts of any kind.
• Child sexual abuse material (CSAM): Any depiction — real or AI-generated — of minors in sexual contexts. This is illegal and will be reported to the appropriate authorities.
• Graphic violence or gore: Content designed to shock, disturb, or glorify extreme violence or bodily harm.
• Hate speech and discrimination: Content that promotes hatred, discrimination, or violence against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or nationality.

VidsHero actively monitors platform use and employs automated and manual content moderation. Any account found generating, distributing, or attempting to generate prohibited content will be:

• Immediately suspended without refund
• Permanently banned from the platform
• Reported to relevant authorities where required by law

If you encounter prohibited content or suspect misuse, please report it to contact@vidshero.com.

9. Limitation of Liability

To the maximum extent permitted by law, VidsHero shall not be liable for any indirect, incidental, special, consequential, or punitive damages including loss of profits, data, use, goodwill, or other intangible losses resulting from your use of or inability to use the service; any errors or inaccuracies in generated content; any unauthorized access to our servers; or any interruption in service.

Our total liability to you for all claims relating to the service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Refund Policy

Due to the nature of our AI service:

• All credit pack purchases are final and non-refundable
• Credits do not expire and remain available for future use
• In the case of verified technical failures (e.g. generation error that deducted credits without producing a video), we may provide credit compensation
• Contact support if you experience significant service issues

11. Account Termination

Either party may terminate this agreement at any time. Upon termination:

• Your access to VidsHero will be suspended
• You retain ownership of all generated and downloaded content
• We may delete your account data after 90 days (upon request)
• No refunds will be provided for unused credits
• You should export and download any videos you wish to keep before closing your account

We reserve the right to terminate accounts that violate these terms or engage in prohibited activities.

12. Changes to Terms

We reserve the right to update these Terms and Conditions at any time. We will notify users of any material changes via email or through our platform. Continued use of the service after changes constitutes acceptance of the new terms.

13. Governing Law

These Terms shall be governed and construed in accordance with applicable laws, without regard to conflict of law provisions.

15. Third-Party Social Media Integration (Zernio)

VidsHero integrates with Zernio, a third-party social media scheduling and publishing API, to enable connections with social platforms including YouTube, TikTok, Instagram, Facebook, LinkedIn, and Pinterest.

• Bring Your Own Key (BYOK): To use social media publishing features, you must provide your own Zernio API key obtained from zernio.com.
• Zero-Knowledge Key Handling: VidsHero does NOT store, log, transmit, or retain your Zernio API key on our servers. The key is stored exclusively in your browser's localStorage and is only used client-side to authenticate with Zernio.
• Zernio Pricing Responsibility: Zernio's free tier supports up to 2 connected social accounts. Connecting additional accounts may incur charges directly on your Zernio account. VidsHero has no control over and does not collect any Zernio fees.
• Zernio's Terms Apply: Your use of Zernio is governed by Zernio's own Terms of Service and Privacy Policy. VidsHero is not responsible for Zernio's availability, uptime, or changes to their service.
• Data Stored by VidsHero: VidsHero only stores non-sensitive metadata (account name, avatar URL, platform name) in its database to display your connected accounts. No social OAuth tokens or API credentials are stored.
